TERMS OF SERVICE

These Terms of Service (“Terms”) apply to your use of the TIGR Pickleball website and to purchases made directly from TIGR Pickleball.
By using this website, placing an order, approving a quotation, or authorizing production, you agree to the applicable provisions of these Terms together with any quotation, proforma invoice, purchase order, order confirmation, approved specification, and other written agreement applicable to your transaction.
1. BUSINESS AND PRODUCTS
TIGR Pickleball supplies factory-direct pickleballs, paddles, accessories, custom-logo products, private-label and OEM/ODM products, molds, tooling, samples, prototypes and product-development services.
Product descriptions, photographs, specifications and other website content are provided to describe our products as accurately as reasonably possible.
Specifications, materials, components or production details may be updated where reasonably necessary for manufacturing, provided that such changes do not materially alter a confirmed order without appropriate customer approval where required.
2. ORDERS AND ORDER CONFIRMATION
Customers are responsible for reviewing product type, specifications, quantities, prices, customization requirements, artwork, shipping information and other order details before placing or approving an order.
Website orders are subject to acceptance and availability.
For wholesale, bulk, custom, OEM/ODM, private-label, tooling, mold and product-development orders, the applicable quotation, proforma invoice, approved specifications, drawings, samples, purchase order, order confirmation or other written agreement may form part of the transaction.
Where transaction-specific written terms differ from these general Terms, the transaction-specific written terms will apply to that transaction to the extent permitted by applicable law.
3. PRICES AND PAYMENT
Prices displayed on the website apply only to the products, quantities and options identified at the time of purchase.
Wholesale, bulk, custom, OEM/ODM, private-label, tooling, mold and product-development pricing may be separately quoted.
A quotation may include separate charges for products, customization, artwork, samples, tooling, molds, packaging, freight, insurance, duties, taxes or other services.
Production may be conditional upon receipt of the payment, deposit or other amount specified in the applicable quotation or order confirmation.
Customers are responsible for any taxes, duties, fees or charges allocated to them under the applicable shipping or trade terms.
4. CUSTOM, PRIVATE-LABEL AND OEM/ODM ORDERS
Custom-logo, private-label, OEM/ODM and made-to-order products are manufactured specifically according to customer-approved requirements.
Production will begin after the required specifications, artwork, samples, pricing and other necessary production details have been approved and any required payment has been received.
Once production has commenced, changes requested by the customer may result in additional costs, production delays or a revised delivery schedule.
TIGR is not required to implement a requested change after production has commenced unless TIGR agrees to the change in writing.
Once the applicable artwork, specifications, samples or production requirements have been approved and production has commenced, the order will be treated as a Final Sale custom production order, subject to our Refund, Return & Claims Policy and applicable law.
5. CUSTOMER-SUPPLIED ARTWORK, LOGOS AND INTELLECTUAL PROPERTY
Customers are responsible for ensuring that they have all necessary rights, licenses, permissions and authority to use any trademark, logo, artwork, design, photograph, text, packaging content or other intellectual property supplied to TIGR.
By supplying such materials, the customer authorizes TIGR to use them solely as reasonably necessary to manufacture, print, package or otherwise fulfill the applicable order.
TIGR does not acquire ownership of customer-supplied trademarks or artwork solely by using them to fulfill an order.
To the extent permitted by applicable law, the customer is responsible for claims arising from materials supplied by the customer where the customer did not possess the necessary rights or authorization to use those materials.
6. PRODUCT APPEARANCE AND MANUFACTURING TOLERANCES
Product colors and appearance displayed on screens may vary from physical products because of monitor settings, lighting, photography, material characteristics and production batches.
Custom and manufactured products may also be subject to commercially reasonable manufacturing tolerances.
Reasonable variations within approved specifications or normal manufacturing tolerances—including reasonable variations in color, printing position, material appearance, dimensions or weight—do not by themselves constitute a manufacturing defect.
Any specific tolerance, acceptance standard or technical requirement expressly agreed in writing for a particular project will take precedence for that project.
7. MOLDS, TOOLING AND PRODUCT DEVELOPMENT
Custom molds, tooling, engineering work, prototypes, samples and product-development projects are specially commissioned projects.
Technical specifications, drawings, development milestones, ownership, usage rights, confidentiality requirements, storage, maintenance, revisions, acceptance standards, handover arrangements and other project-specific conditions may be established in the applicable written quotation or project agreement.
Once approved engineering, tooling, mold manufacturing, prototyping or development work has commenced, amounts corresponding to work already performed, materials procured, third-party commitments made and other costs reasonably incurred are non-refundable except where otherwise agreed in writing or required by applicable law.
Custom molds, tooling and development projects are not subject to the ordinary return provisions applicable to standard non-custom products.
8. SHIPPING AND DELIVERY
Available shipping methods, shipping charges and estimated delivery times are described in our Shipping Policy or in the applicable transaction-specific quotation or written agreement.
Customers are responsible for providing complete and accurate shipping information.
Production, dispatch, delivery and transit times are estimates unless TIGR expressly confirms a guaranteed deadline in writing.
Where TIGR is unable to ship an applicable online merchandise order within a promised shipping period, the order will be handled in accordance with applicable law, including any applicable requirements concerning notice of delay, customer consent, cancellation and refund.

9. RISK OF LOSS, TRANSIT DAMAGE AND CARGO INSURANCE
Risk of loss or damage during transportation will be determined by the applicable Incoterms® 2020 rule, named place or port, shipping term, quotation, proforma invoice, purchase order, order confirmation or other written agreement applicable to the transaction.
Once risk has transferred from TIGR to the customer under the applicable trade term or written agreement, transportation loss or damage occurring after the applicable risk-transfer point will be the customer’s transportation risk, except to the extent directly caused by TIGR’s failure to perform an obligation for which TIGR remained responsible.
International transportation may involve multiple carriers, freight forwarders, warehouses, terminals, customs inspections, loading, unloading and transshipment operations.
Customers are strongly advised to purchase adequate cargo insurance, particularly for molds, tooling, machinery, heavy goods, high-value goods and bulk shipments.
Unless the applicable Incoterms® rule or a separate written agreement expressly requires TIGR to provide cargo insurance, cargo insurance is not included and remains the customer’s responsibility.
A customer’s decision not to purchase cargo insurance does not transfer transportation risk back to TIGR after such risk has otherwise transferred to the customer.

10. RETURNS, REFUNDS AND PRODUCT CLAIMS
Returns, refunds, manufacturing-defect claims, incorrect-product claims and non-conformity claims are governed by our Refund, Return & Claims Policy.
TIGR does not accept returns or exchanges for non-defective products due to buyer’s remorse, change of mind, ordering the wrong product or quantity, personal preference, or other reasons unrelated to a verified product defect or TIGR fulfillment error.
Claims may be accepted for verified manufacturing defects, products materially inconsistent with confirmed specifications, incorrect products or quantities shipped due to TIGR’s fulfillment error, or other verified product non-conformity attributable to TIGR.
Custom-logo, private-label, OEM/ODM and made-to-order products are Final Sale after approval and commencement of production and are not eligible for ordinary cancellation, return, exchange or refund, except for verified manufacturing defects, material non-conformity with approved specifications, or where otherwise required by applicable law.
Wholesale and bulk orders require TIGR’s prior written authorization for any return, replacement, credit or refund.
Transit damage is governed by the transportation-risk provisions of these Terms and our Shipping Policy and does not automatically constitute a manufacturing defect.
Nothing in this section limits any rights or remedies that cannot lawfully be excluded or restricted under applicable law.
11. ORDER CANCELLATION
Requests to cancel standard product orders should be submitted as soon as possible.
Cancellation is not guaranteed once an order has entered processing, procurement, customization, production or shipment.
Once a standard product order has shipped, cancellation is no longer available. Any subsequent claim involving a verified manufacturing defect, incorrect shipment or material non-conformity will be handled under our Refund, Return & Claims Policy.
Custom-logo, private-label, OEM/ODM, tooling, mold and product-development orders may become non-cancellable once specifications, artwork, samples or production requirements have been approved and production, procurement or development work has commenced.
Any permitted cancellation of such a project may be subject to work already completed, materials already purchased, third-party commitments, production status and other costs reasonably incurred.
Nothing in this section limits cancellation or refund rights that cannot lawfully be excluded.
12. ORDER REFUSAL OR CANCELLATION BY TIGR
TIGR may refuse, suspend or cancel an order where reasonably necessary, including where:
• Payment cannot be completed or verified.
• Product availability or specifications cannot reasonably be confirmed.
• Required customization information or customer approval is not provided.
• Shipping or delivery cannot reasonably be completed.
• An obvious pricing, product-information or technical error has occurred.
• The requested order would violate applicable law or third-party rights.
• Fraud or unauthorized activity is reasonably suspected.
Where TIGR cancels an order, any refund legally due will be handled according to the circumstances of the order, work already performed where applicable, our Refund, Return & Claims Policy and applicable law.
13. FORCE MAJEURE AND EVENTS BEYOND REASONABLE CONTROL
To the extent permitted by applicable law, TIGR will not be responsible for delay, loss, damage or failure in performance caused by events beyond TIGR’s reasonable control, including natural disasters, severe weather, fire, flood, earthquake, war, civil disturbance, governmental action, embargo, port closure or congestion, customs action, transportation interruption, carrier failure, labor disruption, epidemic, pandemic or other comparable events beyond TIGR’s reasonable control.
This provision does not exclude any obligation or liability that cannot lawfully be excluded or limited.
14. WEBSITE INFORMATION AND AVAILABILITY
TIGR may update website content, product information, pricing and availability from time to time.
We may correct typographical, pricing, specification or other website errors when identified.
Changes to general website information will not override the material terms of an order already expressly confirmed by TIGR unless the parties agree otherwise or correction is required by applicable law.
15. LIMITATION OF THESE TERMS
These Terms must be read together with our:
• Refund, Return & Claims Policy
• Shipping Policy
• Privacy Policy
• Any applicable quotation, proforma invoice, purchase order, order confirmation or written project agreement
If any provision of these Terms conflicts with mandatory law applicable to a particular transaction, the mandatory law will control to the extent of that conflict.
The remaining provisions will continue to apply to the fullest extent permitted by law.
Nothing in these Terms is intended to waive any right that cannot lawfully be waived.
